Terms of Service

These Terms of Service ("Terms") govern your use of the website namegen.dev and all related services (the "Service"), operated by ModLog UG (haftungsbeschränkt), Rheinstr. 20, 36124 Eichenzell, Germany ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

namegen is an AI-powered name generation platform. The Service uses large language models to generate project and business name suggestions and checks domain availability across multiple top-level domains. The Service is provided via a web interface and a programmatic API.

To use the Service, you must create an account through our authentication provider Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information during registration. You must be at least 16 years old to use the Service.

You agree to use the Service only for lawful purposes. You shall not:

• Use the Service to generate names that infringe on existing trademarks or intellectual property rights of third parties.
• Attempt to circumvent rate limits, access controls, or other technical restrictions of the Service.
• Use the Service for automated bulk operations beyond the scope of your plan or API key limits.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Resell, sublicense, or redistribute the Service or access to it without our prior written consent.

Name suggestions generated by the Service are produced by third-party AI models and are provided as-is. We do not claim ownership over generated name suggestions. However, we make no representations or warranties that generated names are free from third-party rights, including trademarks.

It is your sole responsibility to verify that any name you choose to use does not infringe on existing trademarks, trade names, or other intellectual property rights. We recommend conducting a trademark search before registering or using any generated name commercially.

The Service itself, including its design, code, and underlying technology, remains the intellectual property of ModLog UG (haftungsbeschränkt).

Domain availability information provided by the Service is based on DNS lookups, RDAP queries, and optional registrar API checks at the time of the request. This information is provided for convenience only and does not constitute a guarantee of availability. Domain status may change at any time. We are not a domain registrar and do not register domains on your behalf.

If you access the Service via API keys, you are responsible for securing your keys. Do not share your API keys or embed them in client-side code. We reserve the right to revoke API keys that are compromised or used in violation of these Terms.

We strive to keep the Service available and operational but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will make reasonable efforts to notify you of material changes in advance.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, ModLog UG (haftungsbeschränkt) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service.
• Any names generated by the Service, including any trademark infringement claims arising from your use of generated names.
• Inaccurate domain availability information provided by the Service.
• Unauthorized access to or alteration of your data or transmissions.

This limitation of liability does not apply to damages arising from intent or gross negligence, or where liability cannot be excluded under applicable law.

We process personal data in accordance with our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that your prompts and project descriptions are sent to third-party AI providers (via OpenRouter) for processing.

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason, with reasonable notice where possible.

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

These Terms are governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Fulda, Germany, to the extent permitted by law.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
